Puppy Purchase Agreement

 

Please initial each paragraph, sign at the bottom and mail a copy back to me. Upon receipt of this

signed contract and a deposit, a puppy will be considered yours.

If puppy is being shipped, balance must be paid atleast 7 days in advance, along with fees for shipping.

 

DEPOSITS/PAYMENTS/SHIPPING

 

1.) _______ All puppies require a $500 deposit.  Deposits may be made in the form of cash, personal check

(made out to Shelby Powell) or Money Order.  Once you've chosen a puppy and the deposit has been

made for this puppy, this puppy is yours. If you choose not to get this puppy for any reason, you forfeit

your deposit. If you send an "open deposit" (meaning no pup chosen), then you can wait until we have a puppy

that is available that you like. Deposits are non-refundable -- meaning no money will be refunded at any time.  

 

2.) _______ Choice of puppy is determined on a first come (deposit/contract received) first to choose basis.

Puppy will be placed "on hold" for four business days, while waiting for a deposit. If deposit is not received in

time, the puppy will be placed back up for sale. DO NOT send a deposit unless you know the puppy is still for sale. 

 

3.) _______ Final payment will be made in the form of Cash or Bank/Money Order. All payments must be

made in full before puppy will be shipped or available for pick up.

 

4.) _______ All shipping costs are the responsibility of the buyer.  Depending on whether ground shipping

or air line is used, price ranges from $200 - $350.

 

YOUR BERKSHIRE BULLDOGGE PUPPY IS GUARANTEED AS FOLLOWS:

 

1.) _______ This puppy is guaranteed to be in good physical condition at the time of sale.  It is the

buyers responsibility to take the puppy to the vet within 72 hours that the puppy is in your possession

for the guarantee to be valid. If the Veterinarian finds the puppy to have a serious physical condition

OTHER THAN a viral or bacterial cold or bacterial infection, such as Coccidia or Giardia, which is easily

treated, the seller will replace the puppy with another puppy of comparable or better quality, when

available from same or upcoming litter, after the first puppy is returned to the seller. The seller reserves

the right to a second Veterinarian opinion at the expense of The seller. If the puppy is not examined

within the 72 hours by a licensed Veterinarian, all guarantees listed are not valid. No monies will be refunded.

Puppies are at risk for Coccidia and Giardia (bloody stools) which is often brought on by stress of shipping,

a new home, new food, new people, change of climate or surroundings, etc. 

 

2.) _______ This puppy will be free from genetic/hereditary defects that cause death or serious

impairment of the vital functions in the puppy until said puppy is one year of age. If such an inheritable

disease is documented by a Veterinarian and presented to the Seller with sufficient supporting evidence,

the buyer will be entitled to a replacement puppy of comparable quality, when   one is available,

after the first puppy is returned to the Seller.  We, the sellers, do not agree to compensate the

buyer for any veterinarian expenses.  Failure to return the puppy to the seller within 7 days is

construed to reflect that the buyer is satisfied with the puppy's health and absolves the seller

from responsibility from that day forward for non-genetic illnesses or problems. 

 

3.) _______ If a puppy dies from a genetic or hereditary defect, a necropsy and full report will be

needed and sent to Berkshire Bulldogges.  There are no refunds in part or in full, only replacement

puppies will be given.  The following terms are a few examples of conditions not covered in the

congenital/hereditary health guarantee...mites, coccidia, pneumonia, heatstroke, ringworm, conjunctivitis,

fleas, ticks and ear infections once the puppy has left the sellers hands. 

 

4.) _______ This guarantee does not cover what in the bulldog breed, we consider normal or beyond our

control i.e.: Cherry Eyes, entropian, "loose hips", stenoic nares, skin allergies, such as Demodectic Mange,

or an Umbilical Hernia. We do not breed dogs with undesirable conditions such as mange or bad hips,

but we cannot guarantee that previous generations did not have these conditions in their lines; therefore,

we cannot guarantee these conditions will not show up in future litters. 

 

5.) _______ When you purchase your puppy, he or she has received all necessary vaccinations.  The

buyer(s) agrees to provide annual vet exams, including heartworm checks and preventatives and to do

all vaccinations yearly. Failure to comply with and provide documentation of these requirements voids all

guarantees.  The buyer further warrants that puppy will be kept in appropriate conditions for its health

and welfare.  Puppy will be fed a suitable diet for its age and condition. Puppies will be started on

Nutro Large Breed Puppy food while in my care.  Buyer should continue to feed this or other high

quality Large Breed puppy food for the first 6 months, then Buyer should switch to Large Breed Adult food.

Puppy will receive regular booster vaccinations.  Puppy will receive all necessary veterinary care to maintain

its good health.

 

6.) _______ Your puppy will receive deworming at 2, 4, 6 and 8 weeks of age and their first set of puppy

shots.  You are responsible for any vaccinations after receiving your puppy. 

 

7.) _______ No replacement for temperament as this is environmental and buyers responsibility. As responsible

breeders, we expect this puppy to be socialized and attend a puppy obedience class.  As the breeder,

I do everything possible to breed dogs of sound mind, and body.  Some responsibility is the buyers to

properly socialize, feed, exercise and train this puppy. 

 

8.) _______ If at anytime the Buyer is unable or unwilling to care for this dog, Buyer agrees to contact

and return said puppy to Seller.  Neither refund or replacement of puppy will be given.

 

9.) _______ Puppy is being sold on a SPAY/NEUTER contract with LIMITED registration (unless otherwise discussed)

which will permit this puppy to be registered through the AKC, CKC and/or IOEBA,  but denies registration privileges

to any offspring of this dog and is the sellers confirmation that this puppy is intended as a family

pet and not for breeding. Registration papers will be mailed to you after you send me proof of spay/neuter.

 

10.) _______ When registering this puppy, you agree to use the kennel name "Berkshires" as the

kennel prefix in the registered name of the puppy.

 

 

General Information: Every line of dogs have some issues common to their breed. The Olde English

Bulldogges is a recreation of the bulldogges of Olde and one of the reasons it was created was for the

purposes of eliminating many of the established health problems that the English Bulldog has.  However

the dog is still a Bulldog and some problems may arise that are directly related to what we find more

desirable about the breed...the flat face, rolling gait and big chest for example. Do all the research

you can about this breed and understand and accept that when you purchase a puppy you may have to

deal with some issues. 

 

Stress: one must understand that it is stressful for any puppy to leave its home and littermates. Like 

you, a puppy under stress, is more susceptible to illness. His immune system is compromised while under stress.

There are millions of bacteria, fungi and depending on the environment, viruses all over. If your pup comes

into contact with these while stressed, he will be less able to fight them off. Be very considerate of this

factor, keep the pup quiet and wait until he knows you and is over his stressful time to expose him to new

and excited atmospheres. We strongly suggest you do not expose your new puppy to dog parks, pet stores,

beaches, big parties, etc. until he's had all of his initial puppy shots and has adjusted comfortably to his

new family and home. He is just like a human baby....you know how they catch every cold around?  It's

because they are new to the world and their immune system needs to be exposed to things to become

strong...same as with puppies. Puppies are current on their vaccinations when they leave Berkshire Bulldogges.

You will need to give several more when the pup gets a bit older. Speak with your Vet about what is

appropriate for your area. The incubation for Parvo is 2 - 10 days. Just because your puppy is current

on vaccinations does not mean he is immune. You will be given a Puppy Health Record with your puppy.

This will detail the vaccinations and wormings he has received and when. All the dogs and puppies here

at Berkshire Bulldogges are on a comprehensive health program that was set up with my vet.

 

 

 

The Buyer and the Seller agree that this is the full and complete agreement that exists between the parties

for the sale of this Bulldog.  Any agreements made before this are considered incorporated herein and

any modifications made to this agreement shall be made in writing or such shall not be effective.  I, Shelby Powell, as the breeder, have the right to terminate this contract at any time for any reason.
